Victory for transvaginal mesh victims! On Monday, July 24, 2012, a Californian Court found for a woman who sued Bard, a major transvaginal mesh manufacturer, claiming that the company knew that its mesh product was unsafe. The case had been in litigation for four years. A jury awarded $5 million to the wife and $500,000 to her husband for loss of marital consortium.
Although Bard stopped selling its defective mesh product on July 1, 2012, it only did so after the FDA demanded more clinical trials. Hundreds of thousands of women have been implanted with vaginal mesh, tape or slings and many have had serious side effects as a consequence.
Women who have had mesh implants must act soon to preserve their rights to potential compensation. Time restraints are approaching and some women may not be able to file a claim against the pharmaceutical companies depending on various factors.
